Terms and Conditions
These terms are a legal
agreement between us and can only be modified with our consent. We reserve the right to alter these
terms anytime by changing them on this website.
- Accuracy of Information-
Disclaimer & Copyright
By registering a
properties details with Swap-Homes and making a payment you are indicating you
are its legal owner with the right to sell or have legal power to act on behalf
of the owner.
The personal, property
details and any photographs provided by you are true and accurate. You own the copyright and other rights to
this and licence its use to Swap-Homes.
We are not able to check
the truth and accuracy of information posted to our website. You should, therefore, independently
verify any information before relying upon it because we accept no liability for
any loss or damage resulting from inaccurate information. Please let us know if
you consider any of the information about potential swaps/exchanges we find for
you is misleading. We reserve the right to change or remove any information
registered with us if we consider it misleading, unclear, untrue or it can be
more attractively presented.
In addition to copyright
all the logos on our site are registered trademarks. They can only be displayed on properties
registered with Swap-Homes and by Estate Agents who have registered to use our
service and do so regularly.
- Our
Service
Our service merely
identifies where two parties could buy homes from each other and notifies them
of this. These are potential swaps and we cannot guarantee to find any
particularly where the requirements of the new property are very specific. This is all we undertake to do as we are
not Estate Agents. The number of
potential swaps we find is very dependant on the information you give us about
the new home you wish to buy. The
narrower the search area and the price range you select the less is the
likelihood of finding swaps. These
details can be changed to find more potential swaps by using the edit facility
alongside them on the website page where they are displayed. We are happy to suggest ways of
increasing your potential to find swaps if asked.
Once we have received
payment a property can remain in our database indefinitely. However we will
contact both the seller and Estate Agents by email on a regular basis to ask
whether our service should continue.
Failure to respond will result in our service being terminated and the
full registration fee will have to be paid to restore our service to the
property involved. We endeavour to avoid this and ask that we be kept fully
informed of any developments or problems concerning a registered property.
- Distance Selling
Regulations
It is our understanding
that the statutory 7 day cooling off/cancellation period does not apply where
the performance of that service has already commenced with your agreement. Please note our service commences as
soon as we receive payment because the first search of our database for
potential swaps usually starts at this point. This search is then repeated every time
a new registration occurs or the details of an existing registration are
changed. Thousands of searches
could take place in 7 days. We
therefore cannot and do not operate a cooling off period and will not make
refunds unless searches cease to be performed for a substantial period due to
circumstances entirely within our control.
- Dispute Resolution & English Legal
Jurisdiction
We hope to resolve any
disputes or complaints about our service amicably but in the event of failure to
do so English law shall apply irrespective of where you are based. English courts will have exclusive
jurisdiction to settle any dispute and proceedings will only take place in
England.
